NOTE: This is NOT a summary of Allan Park's ENTIRE Criminal Trial testimony. Essentially, his Criminal Trial testimony was identical to his Preliminary Hearing testimony EXCEPT for that added here. This summary contains ONLY additional information not included in his Preliminary Hearing, added by topic to make comparisons with previous testimony easier. Any CHANGED testimony will be noted.
PARKED CARS:
Marcia Clark said that Park had not be asked during his Grand Jury and Preliminary Hearing testimony, nor in his interview with Shapiro, how he had located the Rockingham residence. He told her that was true and that his mother had pointed that out to him during a conversation. He had actually been driving along looking at house numbers on the curbs. He had therefore found the Simpson address on the curb on the north side of the Rockingham gate, and therefore reasoned there could not have been a car [Bronco] parked there. He acknowledged that when he first arrived he was driving a little bit fast looking for the numbers and passed "it" up. He could not positively say there was a vehicle parked there (outside the Rockingham gate).
When Park pulled in at the Ashford gate, he did see a black 300ZX parked near the Ashford gate.
Allan Park was "pretty sure" he saw two cars parked inside the Rockingham estate. He was positive he saw a Rolls Royce (Bentley), and another "dark" car behind it. The limousine is approximately 28 feet long and it appeared he would have trouble going in through the Rockingham gate. However, he had no problem at all exiting around the two cars [very questionable indeed]. He did not see the Bronco when he first went around to check the Rockingham gate for ease of entrance. He acknowledged that in his Grand Jury testimony he had said when he exited, he looked to his right and "there were no cars."
When Park exited the Rockingham gate there was a car "coming from the North on Rockingham going South." "From what I remember I had to edge out just a little bit -- from what I remember there was a car to the left [Marcia Clark elicited the fact that this was a parked car] and when he came out [i.e., the moving car coming from the North--on Park's right, going to the South--Park's left], something was obstructing my view over here on the right, and I edged out and I let the car go by and then I left." The car on Park's left was "a little farther down" on the curb. Park didn't know whether the "object" on the right obstructing his view was moving or not. He acknowledged that he did not recall whether he saw any parked cars when he exited and that he had testified to that at the Grand Jury. NOTE: Here Park is now saying there was a car parked to the left, while admitting he testified at the Grand Jury that he did not recall whether he saw any cars parked [outside the gate] when he exited.
[SO per his testimony in the criminal trial, there was a parked car to the left of the Rockingham gate as Park exited, and "something" obstructing his view to his right as he was waiting for a moving car coming from his right going toward his left. What was the "something"?]
Park did agree that the neighborhood was quiet that night, and he did observe and see cars that were coming and passing by him while he was waiting.
TIMES OF PARK'S TELEPHONE CALLS AT ASHFORD GATE:
10:43:44 - To Dale St. John's pager number (he left "911" because he didn't know the number of the phone in the limo)
10:46 - To his mother to get St. John's home number
10:49:07 - Dale St. John called Park
REGARDING SEEING THE "WHITE MALE" AND THE "DARK FIGURE"
When Park was talking to St. John he was facing inside the gate, down the driveway toward the house "most of the time."
The light in the driveway was not very bright; he could see from the northwest corner of the garage across the driveway; could not see any further south from that point. The brightest point was the square porch in front of the front door (where a circle was drawn on the exhibit).
The "white male" came from behind the house [Ashford side] and "just stopped" before he got to the driveway. Park did not pay attention to what the white male was doing when he was noticing "the figure" entering the house.
"At the same time" he saw the white male, or just seconds later, he "saw A FIGURE COME INTO THE ENTRANCEWAY OF THE HOUSE JUST ABOUT WHERE THE --WHERE THE DRIVEWAY STARTS." (Emphasis added for comparison with civil trial testimony.)
The figure was 6 feet, 200 lbs, all dark clothing, black. Park could not tell whether it was a male or female, did not recognize the person. Marcia Clark asked if the figure was the same size, height and weight, as Simpson; Park said "Around there."
Marcia Clark specifically asked whether Park could tell "whether the person was coming from the Rockingham driveway or from the area of the garage from the south parkway." Park answered, "NO, I COULDN'T." (Emphasis added for comparison with civil trial testimony.) During cross-examination, Park said he first saw the figure from the corner of the potted plants [on the porch] , "closer to the door."
The figure was "moving not quickly, not slowly, a good pace walk it seemed to be." (NOTE: In his Preliminary Hearing testimony, Park said he was walking "pretty fast.") Lights came on within seconds after the figure entered the house.
Park was still on phone with St. John, told him somebody was home; St. John said, "Fine, finish the job, take him to the airport, and I will see you tomorrow" or something to that effect. Park waited 30 seconds to see if anyone would come and open the gate. Nobody did, so he got out and buzzed again. Simpson answered immediately.
REGARDING LOADING THE BAGS
After Park pulled inside the gate and parked, Kato came up, asked "Is OJ running late?" or something to that effect, and mentioned an earthquake.
The front door was "opened" when Park pulled up, and there were two black duffel bags sitting on the porch, about 36" long (later described as 3' X 1 1/2"), one was unzipped. Park did not load the bags until O.J. came out to tell him to.
While Park was waiting for O.J. to come out, Kato walked to the corner of the garage and called the chow that Park was petting.
When O.J. came out he was wearing stone-washed jeans, a white collared shirt, "with a black coat." Park didn't know if he was wearing the coat or not. He was carrying a Gucci bag. This was the only bag Park saw O.J. carry out of the house. [NOTE: This confirms O.J.'s consistent statements and testimony that he had already put the bags outside before Park pulled inside the gate, which is what he claims he was doing when Park saw him for the first time entering the house.]
Park asked if O.J. wanted the Gucci bag in the trunk, and O.J. told him to put it there. Park stated that after O.J. came out and put the Gucci bag down, O.J. walked "over to the cars" or at least toward the Rockingham gate. He did not see O.J. go out the gate. He saw O.J. go toward the Rockingham gate "two or three times." One time O.J. came back holding his golf club bag, which he handed to Kato and Kato put it in the trunk. O.J. told Park to put the two larger black duffel bags "in the car" [as opposed to the trunk]. The golf bag was in a sheath with some kind of emblem or insignia on it. It did not say "Swiss Army" as big as the one being shown in court. It did say "Swiss Army" but smaller, on a little silk screen white triangle. After seeing the clulbs in court, he "knew" there were more than one Swiss Army emblems because this was different than the one he saw. He was not aware this was a special edition, with a limited number (25) manufactured.
The "small dark duffel bag" was about a foot and a half long, or half the size of the other two, and about 20' away from Park, abaout 3' to 5' behind the bumper of the second car (not the Bentley). This is the bag Kato offered to get but O.J. said "No, no, I'll get it." That was the last bag. Park didn't know where O.J. put that bag, and he didn't look in the trunk before he closed it. [There were five bags: a Gucci bag, two larger black duffel bags, golf club bag, and the smaller duffel. Park acknowledged that what he was calling a "Gucci" bag was actually a "Louis Vuitton" bag and he recognized the little "LVs" on it.]
At the airport, Park opened the door for O.J., then opened the trunk and took the Gucci bag out and put it on the ground. O.J. was carrying one of the larger black duffel bags over his shoulder (with the strap) and was carrying the other one. Park put the golf club bag on the cart, O.J. put the Gucci bag on the cart [this is confusing because sometimes it was Park putting the golf club bag on the cart and sometimes it was O.J., but it does not seem a critical point]. At one point Park saw one of the duffel bags sitting on top of a trash can near the skycap. [The smaller duffel was no longer in sight, which is consistent with O.J.'s testimony that he put it inside the golf club bag cover. This means Park did not see the smaller bag after he saw O.J. pick it up at the house. He did not see it at the airport.]
